Terms and Conditions for Using the www.2n.cz Website

1.1 Operator

The Operator of the www.2n.cz website is 2N TELEKOMUNIKACE a.s., ID No. 261 83 960, with its registered seat in Prague 4, Modřanská 621/72, postcode 143 01, registered in the Commercial Registry maintained by the Municipal Court in Prague, section B, entry 6613 (hereinafter referred to as “2N”).  2N is issuing these terms and conditions for the use of the www.2n.cz website (hereinafter referred to as the “Conditions”).

Every user of the www.2n.cz website must adhere to the Conditions and conduct himself in accordance with them on the www.2n.cz website.

1.2 The Contents of the www.2n.cz Website

The Operator hereby informs users that all of the content on the www.2n.cz website constitutes a work within the meaning of Act No. 121/2000 Coll., on copyright, rights related to copyright, and on amending certain acts (hereinafter referred to as the “Copyright Act”) and enjoy protection within the meaning of the Copyright Act.  For that reason, the content of the website may not be changed in any way or used in any other way than to make use of the www.2n.cz website; the content of this website must not be copied in any way; no interference with its security is permitted; and the website may not be used in violation of the laws of the Czech Republic.  The user may not in any way use the www.2n.cz website or the content thereof for sending unsolicited messages (spam), to change or to harm in any way the content of the www.2n.cz website (e.g., by a virus or another intervention in its structure or contents), to attempt in any way to obtain information about the Operator’s registered customers, or to engage in any other activities that are in violation of the law, these Conditions, or good morals.  If entering parts of the www.2n.cz website that are subject to registration and password, the User may not disclose that password to third persons.  If a section is placed on the www.2n.cz website that is intended for a specific circle of persons (e.g., registered users, employees, trading partners, etc.) and the user is not a member of such a circle of persons, the User shall by no means be entitled to enter that section or to obtain the registration or entry data of third persons to access that section.  The user shall not use another person’s log-in information for accessing such a section.

The content of the www.2n.cz website is for your information only and is of a non-binding nature.  The Operator is not liable for any damage, lost profit, or other harm sustained by property, or otherwise, that the user may incur in connection with its use.  Furthermore, the Operator shall not be liable for any damage, lost income, or other harm sustained by property, or otherwise, that the user may incur in connection with using the www.2n.cz website due to an unauthorised intervention of the user or a third person.

The Operator shall not bear any liability for the content of any advertising placed on the www.2n.cz website or for the content of any websites that may be accessed via the www.2n.cz website (by clicking on advertising or a hypertext link).  The Operator shall not bear any liability should the user sustain any damage, lost profit or other harm sustained by property, or otherwise, incurred by entering or using such third-party websites.

1.3 Monitoring of the User’s Activities on the www.2n.cz Website

The Operator hereby informs the user that it is using, on the www.2n.cz website, a system for monitoring the user’s activities on, and manner of use of, the website, on the basis of which the Operator collects anonymous information about users and their behaviour on the www.2n.cz website.  That information is not of the nature of personal information pursuant to Act No. 101/2000 Coll., on the protection of personal information and on amending certain acts (hereinafter referred to as “Personal Information Protection Act”).  The user cannot be identified on the basis of that information.  The Operator declares that the purpose of the gathering of that information is not to identify, even in part, the user, but to obtain primarily statistical information in order to improve the www.2n.cz website.

The Operator carries out monitoring through the applications Google Analytics, ClickTale, and mYx, through which it monitors, in particular, the following behaviour of the user on the www.2n.cz website: mouse movement, clicking, scrolling, typing of text, completion of forms, tracking of the success rate and completion of forms (referred to as form analytics and conversion funnels), i.e., the monitoring of all of the user’s movements on the www.2n.cz website.  These applications also record other information abut the user, on a general level, such as the pages (within the www.2n.cz website) visited by the user, the time spent on those pages, the country from which the user is connecting to the Internet, the speed of the user’s connection, the type of his Internet connection, IP address, the quality of the resolution of the user’s monitor, the Internet browser used by the user and its settings, the activities carried out by the user on the website, etc.  The applications also record the user’s movements within the www.2n.cz website and save those movements in a video recording that the Operator may subsequently play.

None of the above applications makes it possible to identify a specific user, i.e., it does not gather personal information within the meaning of the Personal Information Protection Act.  These applications are used exclusively for the purpose of monitoring the user’s movements on the www.2n.cz website and the manner of his use of the website, and for the subsequent improvement of the www.2n.cz website with a view to the monitored movement and use by users.

1.4 Personal Information Protection

The Operator hereby informs users that access to some parts of the www.2n.cz website is conditioned on the provision of consent to the processing of personal information within the meaning of the Personal Information Protection Act, and on the provision of personal information.  Without granting such consent, those parts of the www.2n.cz will not be made available to the user.

1.5 Other Provisions

The Operator may change the content of the www.2n.cz website from time to time.  Furthermore, the Operator reserves the right to change these Conditions and user-monitoring applications, without prior notice.
